TERMS & CONDITIONS: THE COLLECTIVE

Membership: The Collective — Monthly Access to Presence Labs
By enrolling in The Collective, you agree to the following terms and conditions:

1. Membership Scope
The Collective is a monthly membership that gives you unlimited access to Presence Labs—group practice sessions with a rotating focus. Membership includes:
Unlimited Presence Labs (group practice sessions) for as long as your membership is active
Labs occur three times per month on a rotating schedule
Access to any supplemental tools or materials shared within the membership, as determined by PresentVoices

Important details:
Presence Labs are held on a recurring schedule and are not recorded for later viewing unless otherwise noted
If you cannot attend a scheduled Lab, you will not receive individual make-up sessions
Access to membership content is available only during an active, paid membership period
Upon cancellation or lapsed payment, access ends at the conclusion of the current billing period

2. Free Trial
PresentVoices may offer a free trial period for new members. If a free trial is offered:
The trial period length will be specified at time of enrollment
A valid payment method is required to begin the free trial
If you do not cancel before the trial period ends, your payment method will be automatically charged the monthly membership rate
You may cancel at any time during the trial period to avoid being charged
Free trials are available to new members only and may not be combined with other promotions
PresentVoices reserves the right to modify or discontinue free trial offers at any time

3. Scheduling & Availability
Presence Labs are held on a rotating schedule set by PresentVoices and subject to change
Labs are first-come, first-served based on capacity
If you cannot attend a scheduled Presence Lab, you will not receive individual make-up sessions
Vacation periods: PresentVoices is closed the last two weeks of August and the last two weeks of December. During these periods, Presence Labs will not be held, but there will still be three Labs in those months.

4. Payment Terms
The Collective is billed on a monthly recurring basis.

By enrolling, you agree to:
Authorize automatic monthly charges to your payment method on file
Pay the monthly membership fee each billing cycle for as long as your membership remains active
Provide a valid payment method and keep it current

If a payment fails:
You will have a three (3) day grace period to update your payment method
If payment is not received within the grace period, access to the membership will be suspended until payment is received
Repeated or unresolved payment failures may result in cancellation of your membership

5. Cancellation Policy
You may cancel your membership at any time by contacting lee@presentvoices.com
Cancellations take effect at the end of the current billing period. You will retain access through the date your current period ends
No partial refunds are issued for unused days within a billing period
Cancellation during a free trial period must occur before the trial ends to avoid being charged

6. Refund Policy
Due to the rolling, access-based nature of this membership, monthly membership fees are non-refundable once charged
If you have concerns before enrolling, please contact lee@presentvoices.com
Exceptions may be made at the sole discretion of PresentVoices in cases of documented extenuating circumstances

7. Confidentiality
All coaching conversations within Presence Labs are confidential
Participants agree to maintain confidentiality of what is shared by others in group settings
PresentVoices will not share details of your participation without your permission
If client stories are shared publicly, all identifying details will be changed to maintain anonymity

8. Community Guidelines
Participants agree to engage respectfully and constructively in all group settings
Harassment, discrimination, or disruptive behavior will result in immediate removal from the membership without refund
You agree not to share login credentials or membership access with non-members

9. Limited Liability & No Guarantees
You are responsible for implementing your own decisions, choices, actions, and results
PresentVoices provides coaching, education, and support, but does not guarantee specific outcomes or results
Results vary based on individual effort, circumstances, and application of the material
PresentVoices is not liable for any actions, inactions, or results stemming from your participation in this membership
Coaching is not therapy, medical advice, legal advice, or financial advice. If you need professional services in those areas, please consult a licensed professional

10. Intellectual Property
All materials, frameworks, concepts, and content provided by PresentVoices within this membership are proprietary
You may not record, copy, redistribute, resell, or claim these materials as your own
You may use the tools and frameworks for your personal and professional development

11. Assumption of Risk
You acknowledge that you are using the information and tools provided at your own discretion and risk
You are responsible for discerning how to apply the coaching and materials to your unique situation

12. Termination of Access
PresentVoices reserves the right to terminate your membership if you violate these terms, engage in harassment, share proprietary materials, or misuse the membership
No refund will be issued in the event of termination due to violation of terms
Any outstanding payment obligations remain binding even if access is terminated

13. Technical Issues
PresentVoices will make reasonable efforts to ensure platform accessibility and resolve technical issues
PresentVoices is not responsible for issues beyond our control, including internet connectivity or third-party platform failures

14. Platform Availability
Membership content and Labs are hosted on or delivered through third-party platforms
PresentVoices is not liable for platform outages, closures, or discontinuation of services by third-party providers
In the event of platform changes, PresentVoices will make reasonable efforts to notify members and, where possible, provide alternative access

15. Changes to Membership Terms or Pricing
PresentVoices reserves the right to modify membership pricing, features, or these terms at any time
Members will be notified of material changes with reasonable advance notice
Continued membership following notification of changes constitutes acceptance of the updated terms

16. Dispute Resolution
If any issue arises, please contact PresentVoices directly at lee@presentvoices.com
If we cannot resolve the issue amicably, you agree to submit the dispute to binding mediation before pursuing legal action
Any legal disputes will be governed by the laws of the State of New York

17. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full effect.

18. Agreement
By completing your enrollment, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
